Gaining permission for taking your child on holiday - post separation

If you have recently separated from your partner who also has parental responsibility for the children, you may find your ex-partner refusing to allow you to take the children on holiday outside of the jurisdiction of England and Wales. A Mediation Information and Assessment Meeting (MIAM) is conducted by an authorised family mediator for the purpose of providing parties with information about mediation and other disputes resolution mechanisms available. The mediator will assess the suitability of mediation for the parties, having particular regard to any domestic violence or risk of harm for children subject to the family application.

Surrogacy and Parental Orders

There are two types of surrogacy’s including partial and traditional surrogacy.

Partial surrogacy involves the surrogate mother’s egg. The commissioning father will donate his sperm in a partial surrogacy and therefore be genetically related to the child too. The commissioning parents are the couple who enter into the arrangement with the surrogate.

Raising a mortgage when you divorce

Within divorce proceedings the court has power to make orders about the family home or any other property you or your spouse own. The Court cannot order a lender to lend you more money, but a properly drafted court order and careful preparation in the run-up to applying for a new mortgage can maximise your borrowing power.
